Terms and Conditions for clients

1. Terms and Definitions

In the present Terms & Conditions, these terms are used and defined as follows:

VENDORS: 

Vendors are the suppliers of AdventureWedding offerings. AdventureWedding vendors are defined as such when their profile appears online on the platform and they can receive bookings via AdventureWedding. Anyone can be an Adventure Wedding vendor who owns a business license, who is able to organize an amazing adventure wedding/elopement experience including a high quality photographic service. Adventure Wedding vendors are usually elopement photographers, and unique wedding planners.

CLIENTS:

Clients are the customers of AdventureWedding, using the platform to make a booking or communicate with local vendors.

USERS

Users are people signing up and creating an account on AdventureWedding. An account is needed in order to create experiences (vendors) and be promoted by adventure wedding, and also in order to chat to a vendor and make a booking (clients). Both vendors and clients are users of the AdventureWedding platform.

2. AdventureWedding Services to Clients

AdventureWedding is an online platform for couples wanting to get married seeking to engage with adventure wedding photographers and planners all over the world to offer them the most outstanding experiences and activities. We are a marketplace where demand (clients) meets supply (local adventure wedding photographers and planners).

Contractual relationship with clients

By making a reservation through our platform, clients enter into a direct contractual relationship with the vendor with whom they make a reservation. From the point when the booking is made, AdventureWedding acts solely as an intermediary between the client and the vendor.  AdventureWedding is not a party to any agreement between the client and the vendor and is not liable for any (attributable) failure to perform or other damages arising out of this relationship.

3. Code of Conduct for AdventureWedding Clients

AdventureWedding connects clients (couples) to local adventure wedding providers around the world offering genuine elopement experiences.

To ensure the connections created are mutually beneficial and respectful, any usage of the AdventureWedding platform must be in line with our Code of Conduct by which users agree:

  • To respect the professionalism of their vendor
  • To not behave in an offensive, aggressive, threatening, harassing, racist or xenophobic nature, or with sexual connotations, inciting violence, discrimination or hatred towards their local vendor and surrounding people
  • To not try to bypass the online booking system of the Platform and trying to make arrangements with a vendor without booking the experience on the platform
  • To not contact an AdventureWedding vendor for a purpose other than:

– Inquiring and arranging details of the booking for a AdventureWedding experience;

– Arranging details of the meeting with the vendor;

– Asking for local tips & advice 

  • To respect local customs and rules & regulations

4. Privacy policy

We respect your privacy and are committed to protect the information you share with us. We believe that you have a right to know our practices regarding the information we collect when you visit our website or use our services. 5. Reservation, payments and communication

All reservations made via AdventureWedding are automatically transferred to the vendor requested. Client can contact AdventureWedding beforehand after registering via the chat feature to ask specific questions regarding the experience.

Bookings as for now are Upon Request meaning they are subject to the vendor confirmation based on their availability. 

A reservation is only valid when confirmed by AdventureWedding via email.

Clients making a reservation with AdventureWedding understand our cancellation policy.

Payments

You deposit 15% of the total amount of your experience through our website to reserve your date. The remaining amount has to be paid to the vendor directly as to their requirements.

The next installment is due after the call with the vendor as per their requirement. In case client fails to to complete payments on deadlines, vendor cannot guarantee holding the date and providing the service.

Communication with vendor

Client understands the importance of entering into communication with vendoir after paying the 15% deposit. In case client does not reply to messages, emails and calls of vendor for 7 days after paying the deposit, vendor cannot guarantee to hold the requested date for client.

6. Cancellation policy

  • 21 days money-back guarantee

Clients, after paying the deposit can enter into direct contact with the vendor. Clients have 21 days to cancel their booking and get a refund in case they feel they are not the right match with that vendor. This is to guarantee customer satisfaction.

Eligibility for Refund

To be eligible for a refund under the 21-day money back policy, customers must meet the following criteria:

    Initiate a video call with the chosen vendor within 21 days from the date of paying their deposit.

    Complete the video call as scheduled or reschedule it with the vendor if necessary.

    Fill out the Adventure Wedding refund form providing sufficient information.

Client is not eligible for money-back guarantee in case they changed their mind due to reasons not having to do with the booked vendor or package (e.g. client decides to elope in a different place or did not read carefully the inclusions listed in the package). This policy is designed to protect against vendor negligence, ensuring that if there is any issue on the part of the vendor, the customer will receive their deposit back, and the booking will be canceled.

Client is also not eligible for money-back guarantee in case they have not provided reasonable amount of availability for a call in the 21 days after booking.

Non-Refundable Fees

Please note that we will not refund the payment processing fees associated with the original booking.

Refund Process

If a customer is eligible for a refund, they can initiate the process by contacting our customer support team and filling out the refund form.

Time Frame for Refund Request

Customers must request a refund within exactly 21 days from the date of their original purchase. Refund requests made beyond this period will not be eligible for consideration.

 

  • Regular cancellation

Our cancellation policy will apply only once your booking is confirmed after your deposit paid. According to our cancellation policy, all payments are non-refundable once the due date of an instalment passes and the transaction has been made. 

  • Force Majeure Situations

In the event that Vendor cancels Services because of a Force Majeure Situation, Vendor must notify AdventureWedding immediately. A Client may cancel a Booking if a Force Majeure Situation occurs at the travel destination, regardless of whether Vendor continues to provide Services during the affected period of time. If Vendor or Client cancels a Booking in connection with a Force Majeure Situation, Client receives a minimum refund of their 15% deposit paid, for the rest of the amount Client and Vendor have to settle in reasonable terms (if  hotel bookings or any expenses were made already which cannot be withdrawn, Client understands that these costs cannot be refunded to them).

  • Substitution, change of date, major unforeseeable event

In case of a major unforeseeable event that will prevent the vendor from providing the service as agreed upon, you might be offered a rescheduling for a few days later and/or a substitute photographer/planner of equal professional level.

7. Self-responsibility for insurance

The price of the services does not include insurance. You are responsible for providing sufficient insurance protection. The requirement for insurance depends on the activity booked.

8. Changes to the program

Furthermore, the Vendor reserves the right to make non-essential changes to the program, if this is necessary due to unforeseeable or unavoidable conditions.

9. Quality of information

While we do our utmost best to verify the quality of the experiences sold by our vendors, we cannot guarantee these are flawless and neither can we guarantee that all content on our website is without errors.

In the event of misleading representation or misconduct on our website or in the framework of the experiences held by vendors through our website and/or services, we may decide, in our sole discretion, to credit the client with a refund for the reservation amount paid or part thereof and charge the vendor with this amount. No action of us may be construed as accepting any liability other than as mentioned herein.

When rendering our service, the information we disclose is based on the information provided to us by the vendors. Although we will use reasonable skill and care in performing our service and verify (most of) the vendors we cannot guarantee that all information is accurate, complete and/or correct. Each vendor remains responsible at all times for the accuracy, completeness and correctness of the (descriptive) information displayed on our platform.

Therefore, use your own best judgment when using any of the services provided by our vendors.

Notwithstanding the foregoing, we, including without limitation any content, data and any information related hereto, is provided on an “AS IS” and “AS AVAILABLE” basis, without any warranties of any kind, express or implied, including but not limited to warranties of title or non-infringement or implied warranties of use, merchantability or fitness for a particular purpose or use.

10. Disclaimer

We do our very best to make sure all the information we provide you is 100% correct. However, as we are human beings too, errors are made.

We hereby disclaim all warranties and conditions with regard to the use of our website and/or services, including, but not limited to the availability, reliability, or quality of our website and services, the events distributed through us, including the nature and quality of the events, and is not and shall not be responsible for any error, fault or mistake of any and all content and information received through our users , including by vendors or clients. We do not endorse any entity, product or service mentioned in any user generated content available on our website.

11. Issues and Complaints

We’ll assist you in case of issues or complaints where possible.

In case of a complaint about, or issue with the platform or services, please contact AdventureWedding at info-at-Adventure-Wedding.com to resolve the problem. In case of a complaint about an experience you agree to contact AdventureWedding within 1 day after the complaint has arisen and you agree to cooperate with and assist AdventureWedding in good faith. You also agree to provide AdventureWedding with such information and take such actions as may be reasonably requested by AdventureWedding. As a vendor you agree that in case of a no show or dissatisfactory deviations in the event caused by you, the client will be refunded and you won’t receive payment. As a guest you understand that in case of a no show or no completion of/interruptions during the event caused by you, you as a client are responsible for any damages up to the amount paid.

In case of any damage claims or other complaints related to the event exceeding the amount paid, AdventureWedding will mediate in finding a reasonable solution between client and vendor.

Any claim or complaint against AdventureWedding in respect of the service must be promptly submitted, but in any event within days after the reserved event has taken place. Any claim or complaint that is submitted after the 14 days period, may be rejected and the claimant shall forfeit his/her right to any (damage or cost) compensation.

12. Applicability of the Terms & Conditions

Any use of our website and/or services, as a website visitor, a client or a vendor, constitutes an agreement to all terms and conditions and warrants that users understand, agree to and accept all terms and conditions contained here.

Vendors on the platform are in compliance with the AdventureWedding Code of Conduct as detailed below.

Clients using our platform and booking our services are required to respect the AdventureWedding Code of Conduct specific to clients detailed above.

13. Proprietary Material

AdventureWedding content may not be used or copied without explicit authorization from AdventureWedding.

All text, graphics, editorial content, data, formatting, graphs, designs, HTML, look and feel, photographs, music, sounds, images, software, videos, designs, typefaces and other content (collectively “Proprietary Material”) on this website is owned by AdventureWedding, or is used with the owner’s permission. This Proprietary Material is protected in all forms, media and technologies. Users may not copy, download, use, redesign, reconfigure, or retransmit anything from this website without AdventureWedding’ prior written permission.

14. Warranties

AdventureWedding does not warrant that this website and/or our services will be uninterrupted or error-free. It may correct, modify, amend, enhance, improve and make any other changes to the website and services at any time or discontinue displaying or providing any content or features without a notice to any user.

15. Liability

AdventureWedding’ responsibility is limited to facilitating the availability of our website, and services. The participation in any of the experiences sold by the vendors is at your own risk.

AdventureWedding’ liability for damages shall be limited to the amount paid by clients, 15% of the total experience price, paid as a deposit when booking.

Except as provided herein, in no event shall AdventureWedding be liable for any indirect, special, incidental or consequential damages of any kind, whether in an action of negligence or other tortious actions resulting from or arising out of participation in any of the experiences sold by the vendors
